1. About This Platform

Onlycarsmalta is an online classified advertising platform based in Malta that allows private individuals and businesses to post and browse used vehicle listings. We are not a vehicle dealer and are not party to any transaction between buyers and sellers.

2. Eligibility

  • You must be at least 18 years of age to create an account or post a listing.
  • By creating an account, you confirm you have full legal capacity to enter into a binding agreement.
  • You must provide accurate and truthful registration information.

3. Seller Responsibilities

  • You must be the legal owner of any vehicle you list, or have explicit authorisation to sell it.
  • All listing information (price, mileage, condition, import status, VRT) must be accurate and not misleading.
  • Vehicles must not be stolen, subject to a finance agreement that has not been disclosed to buyers, or otherwise encumbered.
  • You must disclose if you are listing as a dealer or business, not a private seller. Commercial sellers have additional obligations under Maltese consumer law.
  • You are responsible for arranging a safe handover, providing documentation (registration, road licence, technical inspection), and completing the transfer of ownership in accordance with Transport Malta regulations.
  • Listings must be removed or marked as sold within 48 hours of the vehicle being sold.

4. Buyer Responsibilities

  • Buyers are solely responsible for verifying the condition, history, and legal status of any vehicle before purchase.
  • We strongly recommend arranging an independent mechanical inspection before any purchase.
  • Verify all documentation (logbook, MOT/technical roadworthiness, VRT status, outstanding finance) independently.
  • Never transfer money before seeing the vehicle in person and verifying ownership documents.

5. Prohibited Content

The following are strictly prohibited on this platform:

  • Listings for stolen or illegally obtained vehicles.
  • Fraudulent, misleading, or deceptive listings.
  • Duplicate listings for the same vehicle.
  • Listings that violate any applicable Maltese or EU law.
  • Any form of spam, phishing, or unsolicited commercial communications.

We reserve the right to remove any listing and suspend any account that violates these rules, without notice.

6. Our Role and Liability

Onlycarsmalta acts solely as a platform connecting buyers and sellers. We do not inspect vehicles, verify ownership, endorse any listing, or participate in transactions.

To the maximum extent permitted by Maltese law, we exclude all liability for:

  • The accuracy or completeness of any listing.
  • Loss or damage arising from a transaction between a buyer and seller.
  • Unauthorised access to or alteration of your data.
  • Temporary unavailability of the platform.

Nothing in these terms affects your statutory rights as a consumer under Maltese law.

7. Account Suspension & Termination

We reserve the right to suspend or terminate any account that violates these Terms, engages in fraud, or for any other reason at our sole discretion. You may delete your account at any time from your Profile page.

8. Intellectual Property

You retain copyright over any photos and descriptions you upload. By posting a listing, you grant us a non-exclusive, royalty-free licence to display that content on the platform.

The Onlycarsmalta name, logo, and platform design are our intellectual property and may not be reproduced without permission.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of Malta. Any dispute shall be subject to the exclusive jurisdiction of the Maltese courts.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes are published constitutes acceptance of the updated Terms. We will notify registered users of material changes by email.
